Yes. There’s nothing illegal about that.

It’s no different than if your friend is going to Vegas and asks if you want him to place any bets for you. You tell him sure, bet $500 on the Ray’s under for the season, give him the money, and he returns with your ticket. End of the season, you win (virtual certainty), mail your ticket in, and receive a check.

Or think of it as finding an unclaimed, yet still valid, winning lotto ticket on the ground. You mail it in and you collect. (Of course there have been some lawsuits over disputed lotto tickets, however there’s certainly nothing illegal about your attempt to claim the winnings)

Whoever is in possession of the winning ticket is, if not entitled to the money, certainly not in violation of any laws by claiming it.

The only real problem is if your friend gets stuck and uses your winnings to recover his losses. If he loses that too, you have no legal recourse.

If you take bets for other people and charge a fee, then it is illegal bookmaking. For instance, if someone wanted to bet $50 on the Yankees, and you made him give you $55 and you kept the extra $5, you could face federal bookmaking and racketeering (organized crime) charges. Another way would be to take a $50 bet that wins even money, then keeping part of the profits if they win (If they win, you keep $5 and give them back their original $50 and another $45).All you’re really doing is running a bookmaking organization, and hedging the bets you’re taking by betting at an actual casino.

If all you’re doing is placing the occasional bet for your buddy, I would not worry about it. But if you’re trying to make money by taking bets for people and charging a fee, you could get yourself into some deep doo-doo if anybody found out.

It is probably legal to do it as a favor. However if you are taking a percentage of their winning I think it might cross that fine line.
